1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of boxofpassions.com (the "Site") and any purchases made through it. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms are entered into between you and Box of Passions ("we," "us," or "our").

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to make a purchase on the Site. By placing an order, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

3. Account Registration

Some features of the Site may require you to create an account. You agree to:

  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been used for fraudulent or unlawful activity.

4. Products and Availability

We make every effort to display our products and their colors, descriptions, and specifications as accurately as possible. However, we cannot guarantee that your device's display will be perfectly accurate, and minor variations may occur.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse service to anyone at our sole discretion.

5. Pricing and Payment

  • All prices are listed in U.S. dollars (USD) and are exclusive of applicable taxes and shipping charges, which are calculated at checkout.
  • We reserve the right to change prices at any time before an order is confirmed.
  • In the rare event of a pricing error, we reserve the right to cancel any affected order, even after order confirmation, and will issue a full refund.
  • Payment must be made in full at the time of purchase using one of the accepted payment methods displayed at checkout.
  • By submitting payment information, you authorize us (or our payment processor) to charge the total amount to your selected payment method.

6. Orders and Order Acceptance

When you place an order, you are making an offer to purchase the products listed. We will send an order confirmation email acknowledging receipt of your order. An order is not accepted until we send a separate shipping confirmation email, at which point a binding contract is formed between you and Box of Passions.

We reserve the right to refuse or cancel any order for reasons including, but not limited to:

  • Product unavailability
  • Errors in pricing or product information
  • Suspected fraud or unauthorized payment
  • Inability to ship to the provided address
  • Violation of these Terms

If we cancel an order after payment has been processed, we will issue a full refund to your original payment method.

7. Shipping and Delivery

Shipping costs, methods, and estimated delivery times are displayed at checkout and detailed in our Shipping Policy. Risk of loss and title for products pass to you upon delivery to the carrier.

We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our reasonable control.

8. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. In summary: we accept returns for 30 days from delivery, with free return shipping and no restocking fees.

9. Intellectual Property

All content on the Site — including text, graphics, logos, images, product photography, page layouts, designs, and software — is the property of Box of Passions or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, or use any content from the Site for commercial purposes without our prior written permission. The "Box of Passions" name and logo are trademarks of Box of Passions and may not be used without authorization.

10. User Conduct

When using the Site, you agree not to:

  • Violate any applicable law or regulation
  • Use the Site to transmit fraudulent, harassing, defamatory, or otherwise unlawful content
  • Attempt to gain unauthorized access to any part of the Site, our systems, or other users' accounts
  • Interfere with or disrupt the Site, servers, or networks (including via bots, scrapers, or denial-of-service attacks)

  • Reverse-engineer, decompile, or disassemble any portion of the Site

We may investigate and take legal action against anyone who violates these provisions.

11. User-Submitted Content

If you submit reviews, comments, suggestions, or other content to the Site ("User Content"), you grant Box of Passions a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that User Content in connection with our business.

You represent that any User Content you submit is your own original work and does not infringe the rights of any third party. We reserve the right to remove any User Content at our discretion.

12. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of the Site is at your own risk.

Nothing in this section limits any non-waivable consumer rights you have under applicable law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOX OF PASSIONS AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED THROUGH IT.

Our total aggregate liability for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount you paid for the product giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Box of Passions and its officers, employees, agents, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your misuse of the Site or any products purchased through it
  • Any User Content you submit

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict-of-laws principles. You agree that any legal action arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.

16. Dispute Resolution

Before filing any formal legal claim, you agree to first contact us at 1-838-448-5511 to attempt to resolve the dispute informally. We will work in good faith to address your concern.

If the dispute cannot be resolved informally within 30 days, either party may pursue available legal remedies in accordance with Section 15.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes will be communicated through the Site or by email where appropriate. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Box of Passions regarding your use of the Site and supersede any prior agreements.
